The General Terms and Conditions as described here apply to every product offered per individual quotation or via the LEVEL600 Textile Solutions webshop, the order forms, delivery notes, deliveries and invoices. Any order implies acceptance of these General Terms and Conditions. The General Terms and Conditions of LEVEL600 Textile Solutions are exclusively governed by Belgian law.

If a provision of these general terms and conditions is null and void or nullified, the other provisions of these general terms and conditions will remain in full force and LEVEL600 Textile Solutions and its customer will consult in order to come to new provisions to replace the null and void or nullified provision, taking into account as much as possible the purpose and purport of the null and void or nullified provision.

Purchase and Payment

The agreement between LEVEL600 Textile Solutions and you as a buyer/customer is established at the moment you accept our offer or place an order on our webshop. From then on, these General Terms and Conditions apply. The absence of an ordinary signature does not affect the binding force of the agreement and its acceptance.

LEVEL600 Textile Solutions reserves the right to refuse an order or to subject it to extra conditions such as large orders or incomplete order procedures, or problems with previous orders.

However, LEVEL600 Textile Solutions stands for personal contact: in case of any ambiguities or mistakes, telephone contact will usually suffice for a solution in the interest of both the customer and LEVEL600 Textile Solutions.

At the latest 24 hours after you have made a purchase, either via the Webshop or via direct e-mail to info@level600-ts.com, you will receive an e-mail with an overview of the items ordered. The purchase is only confirmed after LEVEL600 Textile Solutions has sent you an e-mail confirming the goods ordered and the corresponding invoice. If no confirmation email has been sent yet, no sales contract is in effect.

Unless otherwise agreed in writing, products purchased from LEVEL600 Textile Solutions will only be paid for by bank transfer (bank transfer). LEVEL600 Textile Solutions will deliver an invoice to be paid in cash.

LEVEL600 Textile Solutions deliberately chooses not to allow payment by credit card so that no discussions can arise concerning the appropriation of amounts not agreed upon, the incorrect use of credit card data, etc…

LEVEL600 Textile Solutions remains the owner of all goods until full payment has been received.

In case of late payment, LEVEL600 Textile Solutions is authorized to suspend the (further) delivery until you have fulfilled your payment obligations in full.

In case of liquidation, insolvency, application for suspension of payment or a petition for bankruptcy of the customer of LEVEL600 Textile Solutions, the customer’s obligations are immediately due and payable.

Delivery and delivery times

Typically LEVEL600 Textile Solutions delivers the ordered products within 6 working days (standard products) or 4 weeks (customized products) to the delivery address of the customer. However, as LEVEL600 Textile Solutions obtains suppliers from all over the world, this is not a guaranteed period. The deadline for delivery is 6 weeks after receipt of payment, with the exception of custom-made products such as bed, bath or table linen, custom-made curtains, beds and mattresses, etc. For the custom-made products, LEVEL600 Textile Solutions will provide you with an expected delivery date as accurately as possible.

Under no circumstances will the mere exceeding of a given delivery time cause LEVEL600 Textile Solutions to be in default.

If a product, which is temporarily out of stock, is ordered by you, it will be indicated when the product will be available again. The other products that are part of your order will nevertheless be delivered and must be paid for. Partial deliveries are possible.

As soon as the products to be delivered have been delivered to the specified delivery address, the risk for these products is transferred to the buyer.

For deliveries abroad, different conditions may apply. LEVEL600 Textile Solutions delivers in Belgium, the Netherlands, Luxembourg and Germany.

Delivery is exclusively by courier service unless otherwise agreed prior to the agreement. LEVEL600 Textile Solutions will, as soon as known, communicate the trace&track details of the shipment to the customer.

Product information

Information, images, verbal announcements, declarations, etc … shall be monitored as closely as possible with regard to the main characteristics of the products. LEVEL600 Textile Solutions is not responsible for advice given by it, printing and typesetting errors on the website or technical data provided by suppliers or producers.

In case an ordered product turns out to be unavailable, LEVEL600 Textile Solutions will inform the customer immediately.  LEVEL600 Textile Solutions makes every effort to communicate these data correctly. Nevertheless, it may happen that there is an impossibility to deliver, for example due to unintentional incorrect stock data or products that are no longer available from the suppliers. In these cases LEVEL600 Textile Solutions will inform you as soon as possible and propose a solution.

The products offered by LEVEL600 Textile Solutions meet the legal standards and may be sold online.

LEVEL600 Textile Solutions is authorized to deliver goods and perform services that deviate from what has been agreed on subordinate points. The following are regarded as deviations on minor points: minor differences in colour, design, weight, pattern and/or size.

It is possible that LEVEL600 Textile Solutions includes links on its website to other websites that may be interesting or informative for the visitor. Such links are purely informative. LEVEL600 Textile Solutions is not responsible for the content of the website referred to or the use of it.

Defects

You are obliged to carefully inspect the goods (or have them inspected) immediately upon receipt. In doing so, you must check whether the delivered goods comply with the agreement: have the correct goods and quantities been delivered, do the delivered goods meet the agreed quality requirements, etc.? If a visible defect or shortcoming is detected, the customer must report this to LEVEL600 Textile Solutions immediately after delivery and on the same day of delivery.

If and insofar as the customer is of the opinion that a delivered product does not comply with the agreement, then the customer is not authorized to treat and/or process the product, and the customer will keep the product identifiable and separate. If the customer processes the delivered product or has it processed, and/or transports the delivered product himself or has it transported, all claims against LEVEL600 Textile Solutions regarding possible defects will lapse.

Force majeure

Force majeure is understood to mean all external causes, foreseen or unforeseen, on which LEVEL600 Textile Solutions cannot exert any influence, but which prevent LEVEL600 Textile Solutions from fulfilling its obligations.

LEVEL600 Textile Solutions also has the right to invoke force majeure, if the circumstance preventing (further) compliance occurs after LEVEL600 Textile Solutions should have complied with its obligation.

During force majeure the delivery and other obligations of LEVEL600 Textile Solutions will be suspended. If the period in which fulfilment of the obligations by LEVEL600 Textile Solutions is not possible due to force majeure lasts longer than 8 weeks, both parties are entitled to dissolve the contract, without any obligation to pay damages in that case.

Prices

Before settlement, the prices of the goods will be communicated. All prices are expressed in Euros and are exclusive of VAT, Recupel, BEBAT and Reprobel. Shipping costs are charged separately.

If LEVEL600 Textile Solutions agrees a certain price with the customer, LEVEL600 Textile Solutions is nevertheless entitled to increase the price and will inform the customer about this. The customer then has the right to cancel the order of the product in question.

LEVEL600 Textile Solutions can stop any ACTION, indicated with products, at any time.

If a price increase takes place after confirming the purchase, the customer can cancel the purchase regardless of the percentage of the increase.

An offer made by name has a validity of 1 week, unless another period is mentioned in the offer.

Intellectual property rights

The contents of this site, including brands, logos, photographs, drawings, data, product or company names, texts, images, etc. are protected by intellectual rights and belong to LEVEL600 Textile Solutions or entitled third parties.

Questions and complaints

Complaints or disputes must be reported within 2 days after delivery. In case the complaint is found to be justified, the liability of LEVEL600 Textile Solutions is limited to the exchange of the goods. Any liability of LEVEL600 Textile Solutions is limited to the actual amount paid for the order.

LEVEL600 Textile Solutions always handles questions and complaints within a reasonable period of 7 calendar days after receipt of the question or complaint.

Exercise the right of return

The customer has the right to return goods, provided that the product is in its original packaging, has not been washed, has not been used, is in its original condition and with any tickets attached.

In order to be eligible for an exchange of the product and a refund of the amount paid, the following conditions must be met: (1) The customer must notify LEVEL600 Textile Solutions of the complaint, the request for exchange or the request for a refund within 7 days after receipt of the articles. This must be done in writing by means of a registered letter, or an e-mail for which the customer explicitly requests the confirmation of good receipt (2) Special made-to-measure items, or items that have been processed, printed or embroidered, cannot be exchanged or returned, (3) The products must be in the possession of LEVEL600 Textile Solutions within 14 days after your notification that you wish to make use of the right of withdrawal. A LEVEL600 Textile Solutions signed proof of receipt and successful delivery is the only proof. (4) The products must be returned to LEVEL600 Textile Solutions sufficiently stamped. The costs of returning the products will be at the expense of the customer, unless LEVEL600 Textile Solutions has explicitly agreed otherwise with the customer. (5) Unstamped or insufficiently stamped parcels, or parcels returned without the prior agreement of LEVEL600 Textile Solutions will not be accepted, (6) LEVEL600 Textile Solutions is not responsible for theft or damage during the return process on the initiative of the customer, (7) if the customer wishes to cancel, revoke, cancel or return his purchase in the manner described above, LEVEL600 Textile Solutions will refund the amount of the products sold, within 14 days after receipt of the return. With regard to all the above, the only correct return details of LEVEL600 Textile Solutions are as follows:

All offers and agreements are exclusively governed by Belgian law.

Limitation of liability
